Conditions of Purchase through the Katy Shop Pro Application
KATYSHOP.RO LTD, company number 17348937, registered office 57 Prospect Drive, Shirebrook, Mansfield NG20 8BH, England (the "Company"). Effective date: 4 October 2026. Version: 1.0.
These conditions supplement, and are to be read together with, the Terms of Service, the Refund Policy, the Shipping Policy and the Privacy Notice. In the event of any inconsistency, the Terms of Service prevail. Terms defined in the Terms of Service bear the same meaning herein. Nothing in these conditions excludes or restricts any right conferred upon a consumer by the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
1. Eligibility
1.1 Purchases through the Katy Shop Pro application (the "App") are reserved to natural persons who have attained the age of eighteen years, acting as consumers, who hold an account created by authentication through Google or Apple and who have supplied an accurate date of birth, delivery address and telephone number.
1.2 The Company may suspend or close an account in the circumstances set out in the Terms of Service, including abuse of the chat facility or repeated failure to pay for reserved Items.
2. Methods of acquisition
2.1 Live Sale. During a broadcast, an Item presented by the host is displayed in the App with its price. The first User to press "Îl vreau" ("I want it") secures the reservation of that Item at the displayed price.
2.2 Auction. In the Auctions section, each bid constitutes an offer to purchase at the amount bid, binding upon the User subject to clause 3. At the close of bidding, the Item is reserved to the highest bidder, provided that any reserve price displayed has been attained.
2.3 Effect of reservation. A reservation under clause 2.1 or 2.2 withdraws the Item from sale and places it in the User's Basket. In accordance with clause 5.3 of the Terms of Service, a reservation does not of itself conclude a contract of sale; the contract is concluded upon payment.
3. The Basket and withdrawal before payment
3.1 The Basket records the Items reserved to the User, the total payable and the date by which payment is requested, as indicated in the App.
3.2 A User who no longer wishes to purchase a reserved Item may, before payment, so inform the Company by any means through which the Company is available, whether orally (including during a broadcast) or in writing (including by WhatsApp or electronic mail), whereupon the Item shall be removed from the Basket immediately, without discussion and without charge. The Company never requires a User to purchase an Item with which the User is not satisfied.
3.2A Payment is enabled only after the Company has approved the Basket. The User shall verify the contents of the Basket before paying, as provided at clause 6.2A of the Terms of Service.
3.3 Where payment is not made within the period indicated in the App, the Company may release the Item in accordance with clause 6.3 of the Terms of Service. Repeated non-payment may be taken into account in the contest score, as provided in the contest rules.
3.4 Suspension for non-payment. Where the Items in the Basket are not paid for within seven days from the reservation of the earliest unpaid Item, or within such longer period as the Company may allow, the unpaid Items are released for sale and the account is automatically suspended from bidding in Auctions and from reserving Items in a Live Sale. During the suspension the User remains able to pay any sum still outstanding. The Company may lift the suspension. Upon a second suspension the User is notified by electronic mail that a further instance will render the suspension permanent, and upon a third suspension it becomes permanent.
4. Price and payment
4.1 Prices are stated in pounds sterling. The Company is not registered for Value Added Tax and no VAT is charged. The cost of delivery is shown separately before payment.
4.2 Payment is effected through a payment page operated by Revolut Ltd or, where the App offers payment by instalments and the User so elects, by Stripe Payments UK Ltd with Klarna or Clearpay. Card particulars are never received by the Company. Any instalment credit agreement is concluded solely between the User and the credit provider, as provided at clause 7.3A of the Terms of Service.
4.3 An invoice is issued upon payment and sent to the electronic mail address held on the account.
5. Delivery and collection
5.1 Paid Items are despatched in accordance with the Shipping Policy. Where the Company has agreed with the User that the Items will be collected in person, the arrangements agreed in writing apply.
6. Cancellation, returns and statutory rights
6.1 The statutory right of cancellation applies to Items purchased in a Live Sale and in an Auction conducted through the App, as set out in the Refund Policy. Faulty or misdescribed Items attract the remedies provided by the Consumer Rights Act 2015.
7. Responsible purchasing
7.1 The Company encourages every User to purchase only what the User can afford, and does not wish any User to purchase beyond the User's means. The Company reserves the right, in its discretion, to decline or limit further reservations where it has reason to believe that a User is purchasing beyond the User's means, including by the suspension provided for at clause 3.4. Each User nonetheless remains responsible for assessing the User's own means and for every purchase the User makes.
7.2 The Company does not employ false scarcity, fictitious reductions or misleading time pressure, and the countdowns and quantities shown in the App reflect the actual position.
8. Contest
8.1 Participation in the monthly contest and in the evening prize is governed by the rules published at live.katyshop.cloud/regulament and by clause 7.6 of the Terms of Service. A purchase may contribute to the contest score but confers no other advantage in the contest.
