These particulars are published in accordance with regulation 6 of the Electronic Commerce (EC Directive) Regulations 2002 and sections 82 and 83 of the Companies Act 2006.
2. Regulated activity and authorisations
2.1 The Company carries on the retail sale of goods. It does not carry on any activity regulated under the Financial Services and Markets Act 2000.
2.2 Payment services in connection with the Services are provided by Revolut Ltd and, for payment by instalments, by Stripe Payments UK Ltd with Klarna and Clearpay, each of which is authorised and regulated in its own right. The Company neither holds client money nor executes payment transactions.
3. Hosting and technical infrastructure
3.1 The Website is hosted by Shopify Inc., 151 O'Connor Street, Ground Floor, Ottawa, Ontario K2P 2L8, Canada.
3.2 The application server supporting Katy Shop Pro is operated on the Company's behalf by DIG WILD LTD (company number 16723627), under a written data processing agreement, and is situated in the United Kingdom. Network protection and content delivery are provided by Cloudflare, Inc.
3.3 The relay carrying the live video signal is operated by Hetzner Online GmbH, Industriestraße 25, 91710 Gunzenhausen, Germany.
4. Responsibility for content
4.1 KATYSHOP.RO LTD is responsible for the editorial content it publishes through the Services.
4.2 The Services include a live chat in which users may post messages. Such messages are the content of the users who post them. The Company does not adopt them as its own and, in respect of information stored at the request of a user, relies upon the defence at regulation 19 of the Electronic Commerce (EC Directive) Regulations 2002. Upon obtaining actual knowledge of unlawful content, the Company acts expeditiously to remove it.
4.3 Messages may be reported within the application. Reports are reviewed by the Company.
5. Intellectual property
5.1 All content published through the Services — including text, photographs, video broadcasts, graphics, layout, the names "Katy Shop" and "Katy Shop Pro", the associated logos and the animated character "Gugu" — is the property of KATYSHOP.RO LTD or of its licensors, and is protected under the Copyright, Designs and Patents Act 1988 and under trade mark law.
5.2 No licence is granted save that expressly set out in the Terms and Conditions. Reproduction, distribution, public performance, retransmission or adaptation of any part of that content without prior written consent is prohibited.
5.3 The recording of live broadcasts and the capture of screen images are prohibited and are technically restricted within the application.
5.4 A person who considers that content published through the Services infringes a right belonging to them is invited to notify the Company at [email protected], identifying the content and the right asserted.
5.5 The software of the application Katy Shop Pro and of the servers supporting the Services is protected as a literary work under the Copyright, Designs and Patents Act 1988. Copyright therein vests in its author, who has licensed its use to KATYSHOP.RO LTD for the conduct of its business.
5.6 The names and marks of the manufacturers of goods offered through the Services belong to their respective owners and are used solely to identify those goods; no affiliation with, or endorsement by, any such owner is implied.
6. Accuracy of information
6.1 The Company takes reasonable care to ensure that the information published through the Services is accurate and current.
6.2 No warranty is given that such information is free from error or omission. This clause does not limit the Company's obligations under the Consumer Rights Act 2015 in respect of goods sold, nor its liability for fraudulent misrepresentation.
7. External links
7.1 The Services may contain links to websites operated by third parties, provided for convenience.
7.2 The Company exercises no control over such websites and accepts no responsibility for their content, their availability or their treatment of personal data.
8. Consumer rights and complaints
8.1 A consumer with a complaint is invited to write to [email protected] in the first instance.
8.2 Nothing in this Notice affects the statutory rights of a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other enactment.
9. Data protection
The processing of personal data is described in the Privacy Notice, which forms part of the documents governing the Services.
10. Governing law
10.1 This Notice and any matter arising from the use of the Services are governed by the law of England and Wales.
10.2 The courts of England and Wales have jurisdiction, without prejudice to the right of a consumer resident elsewhere in the United Kingdom, or in a Member State of the European Union, to rely upon the mandatory provisions of the law of that jurisdiction and to bring proceedings before its courts.
